Former shoe retailer fined $71,500 after underpaying employee

The former operators of a shoe retailer in Sydney have been fined $71,500 after it underpaid a retail employee.

Winton Jacob International Pty Ltd was fined $60,000, while its sole director, Winton Guo, was fined $11,500, according to a media release from the Fair Work Ombudsman (FWO).

The Federal Circuit and Family Court has also ordered the operator to backpay the underpaid retail employee $15,174, in addition to interest and superannuation.

Breaches committed

The penalties stem from Winton Jacob International's failure to pay the retail employee their minimum wages, weekend and public holiday penalty rates, as well as leave entitlements, according to the Fair Work Ombudsman.

The operator received a Compliance Notice, which ordered it calculate and back-pay the worker's entitlements between November 2019 and June 2021.

It failed to act on the notice, according to the FWO, and failed to issue pay slips, resulting in the penalties.

"When Compliance Notices are not followed, we will continue to take legal action to protect employees. Employers who fail to act on these notices risk substantial penalties and back-pay orders," said Fair Work Ombudsman Anna Booth in a statement.

"Any employees with concerns about their pay or entitlements should contact us for free advice and assistance."
