12 employers temporarily banned from TFW Program

For the year 2025 so far, the federal government has already temporarily banned 12 employers from accessing the Temporary Foreign Worker (TFW) Program.

Among these employers, Petro-Canada Grassland and Farmtrux Logistics are facing the longest ban. 

Petro-Canada Grassland  will not be able to access the TFW Program until March 7, 2023 for committing the following violations:

  • The employer didn’t keep documents that showed they met the conditions of employing a foreign national, for a period of 6 years, starting on the first day the foreign national worked for them.
  • The employer couldn’t show that the description they gave for the job on the Labour Market Impact Assessment application was true, for a period of 6 years, starting on the first day the foreign national worked for them.
  • The employer didn't give the inspector the documents they asked for.
  • The pay or working conditions didn't match, or were not better than, what was listed on the offer of employment, or the job was not the same as what was listed on the offer of employment.
  • The employer didn't put in enough effort to make sure the workplace was free of any of the following:
    • physical abuse
    • sexual abuse
    • psychological abuse
    • financial abuse
    • reprisal

The employer must also pay a fine of $164,000.

Meanwhile, Farmtrux Logistics will not be able to access the program until Feb. 4, 2023 for not providing documents that an inspector asked for.

Recently, the federal government temporarily banned 24 Canadian metropolitan areas from accessing a feature of the TFW Program, in accordance with a policy change that Ottawa announced in 2024.

How can an employer re-apply for the TFW Program?

Employers hoping to access the TFW Program once more must do the following, according to the federal government:

  1. Fulfill the ban period.
  2. Settle any outstanding penalties.
  3. Demonstrate compliance measures.
  4. Reapply for the program by submitting a new Labour Market Impact Assessment (LMIA) application.
  5. Undergo inspection and monitoring.

The federal government has made numerous changes to its immigration rules, and many stakeholders have criticized these changes.
