The pandemic has upended almost every aspect of organizational strategy – but one could argue that no sector had to deal with quite so many seismic changes as employment law.
From health and safety laws to remote working legalisations to vaccine mandates, navigating the employment law sphere of the past couple of years has been trying at best. With that in mind, HRD is launching our famous Employment Law Masterclass 2023 – an event designed to educate and inform HR leaders on upcoming legal changes.
Speaking at the event is Matthew Certosimo, partner at Borden Ladner Gervais LLP and renowned legal author. In his session, Certosimo will be talking on his topic of expertise – just cause in terminations.
Certosimo actually wrote a book with his late co-author Randy Echlin - Just cause: The Law of Summary Dismissal in Canada, a best-selling hit.
“It’s always been the ‘capital punishment of the employment relationship,’ but just cause had not been the focus of sufficiently close analysis,” Certosimo tells HRD. “Randy and myself felt that the workplace parties, lawyers and the courts could use such a treatise.”
Each year, just cause cases are forwarded to Certosimo so he can read them closely and update the text appropriately.
“Sometimes, it’s just a matter of adding a new case to an existing footnote – however, other times a significant case comes along and I like to ensure that it’s fully and properly discussed in that year’s supplement.”
