Agency's licensee convicted of attempting to overcharge foreign domestic helper
Hong Kong's Labour Department (LD) has revoked the employment agency licence of Saiko Hong, an agency located in Sheung Wan, after its licensee and an associate were convicted of attempting to overcharge a foreign domestic helper.
According to the LD, the licence was revoked due to violations of the Employment Ordinance (EO).
Under the EO, the Commissioner for Labour has the authority to revoke an employment agency's (EA) licence if there are reasonable grounds to believe that the licensee or any individual employed by the agency has contravened specific provisions of the law.
"The EO stipulates that the Commissioner may refuse to issue or renew a licence, or may revoke a licence, if she is satisfied on reasonable grounds that the licensee or the person intending to be the licensee of an EA, or a related person of or an individual employed by the licensee or the person intending to be the licensee, has contravened any provision of Part XII or any regulation made under section 62 of the EO, such as overcharging job seekers or operating an EA without a licence, or has not complied with the Code issued under section 62A(1) of the EO," a spokesman for the LD said in a statement.
The LD then reminded operators of EAs to always remain compliant with the law and the requirements of the Code of Practice for EAs.
Any enquiries or complaints about suspected violations of EAs should be raised to the Employment Agencies Administration of the LD, it added.
